Six held in vicious beating

Police describe attack on man as "torture"

October 14, 2006

A group of men pummeled a sign company worker with their fists and feet, beat him with a baseball bat and board and smashed him with a vase in an attack Memphis police are calling torture.
The reason for the attack? He apparently kept a company truck too long, police said.

Phillip Godman, 49, who worked for Tennessee Sign Services at 2497 Broad, was taken to the Regional Medical Center at Memphis Tuesday night after police found him bruised and bleeding at the shop.
He remained in extremely critical condition Friday, suffering from a cerebral hemorrhage, skull fractures and brain stem damage.

On Thursday, police charged Tommy Bates, 43; Theodore Bruehl Jr., 38; Billy Hatley, 48; Ronald E. 'Lomax' Lee, 42, and Cary M. Wilson, 18, with attempted first-degree murder. Connell W. Yarbrough, 36, was charged with aggravated assault. The arrest of another suspect is expected, police said.

The small sign company in Midtown Memphis is unmarked save for "Signs & Printing" on its glass front doors. No one answered a reporter's knocks Friday.

Police said Godman was attacked because he left work with the company truck and did not return for several days.

Memphis homicide Lt. Joe Scott said Godman was still working for the company when he took the truck, which was not reported stolen, and the suspects were sent to get it back.

According to various court documents and police:

Bruehl told investigators that another person, who has not been charged, offered him $100 for Godman's location. Bruehl knew, but ended up getting $20.

Godman was visiting a home in the 2000 block of Southern when the group arrived at about 11 p.m. Bruehl said he knocked on the door and the others rushed in.

Wilson punched Godman, who was sitting in a chair, then beat him with a board. Lee struck Godman with a vase. Investigators noted a cut on Lee's hand. The victim also was beaten with a baseball bat.

Godman seemed unconscious when Lee and Bates carried him out of the home and placed him in the bed of a red Chevy. Bates drove it back to the sign shop. Bruehl rode with him and the others followed in another vehicle.

Yarbrough was at the shop when they arrived. Wilson punched Godman as he was being pulled from the truck. Hatley hit him with a board and kicked him. The beating continued.

Meanwhile, Scott said, people at the house on Southern called police and told officers where the group was headed.

"The people from Southern Avenue called and knew what was happening," Scott said.

In a statement, Scott credited the officers who made the arrests with "stopping the on-going assault, which can best be described as torture in nature."

Philip Godman died Tuesday, and a group of men accused of beating him for keeping a company truck too long will be charged with murder.
His death marks 132nd homicide this year in Memphis.

Godman, 49, worked for Tennessee Sign Services at 2497 Broad. He was hospitalized at the Regional Medical Center at Memphis the night of Oct. 10, after police interrupted the beating and arrested the suspects.
He had apparently sustained a cerebral hemorrhage, skull fractures and brain stem damage.

On Oct. 12, police charged Tommy Bates, 43; Theodore Bruehl Jr., 38; Billy Hatley, 48; Ronald E. 'Lomax' Lee, 42, and Cary M. Wilson, 18, with attempted first-degree murder. Connell W. Yarbrough, 36, was charged with aggravated assault. His amended charge has not yet been determined, said Memphis police spokesman Sgt. Vince Higgins.

Police said Godman was attacked because he left work with the company truck and did not return for several days.

He was allegedly pummeled with fists and feet, a baseball bat, a wooden plank and a glass vase. Police characterized the attack as torture.

Memphis homicide Lt. Joe Scott had said Godman was still working for Tennessee Sign Services when he took the truck and the suspects were sent to get it back. The truck had not been reported stolen.

According to court documents, Bruehl told investigators that another person, who has not been identified or charged, offered him $100 for Godman's location. Bruehl knew, but got $20 instead.

The beating apparently began at a home in the 2000 block of Southern Avenue, where the men found Godman at about 11 p.m.

He was barely conscious when the men loaded him into a pickup bed, took him to the sign company and continued the beating, police said. Yarbrough met the group at the shop.

In the meantime, witnesses alerted police to the abduction and provided information on the group's whereabouts. Officers arrived at the sign company, stopped the beating and detained the suspects. The investigation is continuing.
