Two Are Accused Of Shooting Child

STOCKTON, Calif. -- A Stockton mother was arrested Friday on suspicion of letting her teenage son shoot another child with a BB gun.

Investigators said Linda Mendoza, 43, was driving with her 14-year-old son and two of his friends when the boy asked her to stop the car so he could shoot a child walking down the street.

Police said the victim was hit in the body and eye, but was not seriously hurt.

Police said Mendoza returned to the scene and offered the victim a BB gun and said he could shoot her son back. The victim refused and ran home, according to police.

Mendoza was later arrested on charges of contributing to the delinquency of a minor, assault with a deadly weapon, conspiracy to commit a crime and willful cruelty to a child.

Her son was also arrested and booked into juvenile hall on charges of assault with a deadly weapon and conspiracy to commit a crime, police said.

Police said several BB guns were found in Mendoza's vehicle.

and justify shooting someone with a BB gun?

STOCKTON - A 43-year-old Stockton mother was arrested Friday for stopping her Ford Explorer so her 14-year-old son could shoot another boy with a BB gun. The boy was hit in the eye but not seriously injured.

"Stop, I want to shoot him,'' the boy told his mother just before she pulled the vehicle over and her son shot the other boy about 2 p.m. Friday near the intersection of Grant and East Fourth streets in south Stockton, police said.

"I meant to shoot you lower," the shooter told the victim after hitting him in the eye, Stockton police Lt. Cris Trulsson said.

The mother, Linda Mendoza, got out of the vehicle to examine the wounded boy and told him, "You are OK." She then offered him a BB gun so he could shoot her son, Trulsson said.

The victim declined and ran home.

Mendoza was arrested a few blocks away on suspicion of assault with a deadly weapon, contributing to the delinquency of a minor and child abuse. Her 14-year-old son, who was not named by police, was arrested on suspicion of assault with a deadly weapon and conspiracy.

There were two other 14-year-olds and a total of four BB guns in the car, police said. The two other boys in the Ford Explorer were friends of Mendoza's son, police said. They were released to their parents.

"Mom was driving them around and knew what was going on," Trulsson said.

Two of the BB guns in the sport utility vehicle were handguns; a third looked like an Uzi, and the fourth looked like an assault rifle, Trulsson said. The bright orange rings at the end of the guns' barrels, which are required on replica guns to indicate they are not real weapons, had been blacked out, he said.

Stockton Police Department spokesman Officer Pete Smith said the outcome in Friday's shooting could have been worse - not just for the victim, but for the shooter.

"This was serious, but they could point this weapon at somebody else, or at a police officer, and been killed," he said, referring to the replica guns' realistic appearance.

BB guns are legal, but it is considered assault with a deadly weapon and, therefore, a felony, when they are used against a person.

"It just makes you sick to your stomach," Smith said. "Here we are out here as a law enforcement agency, as a community, beating our brains out to get a handle on (crime), and this woman goes so far out of the realm of reasonable behavior. You just have to shake your head."

Folsom police recently investigated a similar case in which a woman drove her son to a fight with a fellow student, cheered him on as he hit a smaller boy and then kept other bystanders from intervening.

It was the second time this week a BB gun was used by a child against another in Stockton. On Tuesday, a 15-year-old boy shot a 5-year-old girl in the face when she refused to give up her Lego toys, police said. Police are still looking for the boy. The girl was not seriously injured.

Smith said Friday's case was particularly upsetting because the shooter's mother was an accomplice.

In Stockton, BB guns have been used in several other recent crimes. Earlier this week, a Stockton Police Department crime technician was shot through the open window of a city van. BB guns also have been used in armed robberies, including a convenience store robbery in January.

Residents in the area where the shooting occurred were outraged. Chris Flores, 18, was playing with his nephew near the intersection of Fourth and Grant streets when he heard what happened.

"I don't know how a mother could drive around and help her son shoot somebody," he said, shaking his head.
